Please read these Terms of Service carefully before using the DeepWaves platform. These terms govern your use of our services.
By accessing or using DeepWaves ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.
DeepWaves is a digital music platform that enables independent artists, labels, and promoters to upload, distribute, and sell music, sample packs, and event tickets. The Platform also provides record pool services, analytics, and promotional tools.
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You may not use another person's account without permission.
You retain ownership of all content you upload to the Platform. By uploading content, you grant DeepWaves a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as necessary to provide the service. You represent that you own or have the necessary rights to all content you upload, and that your content does not infringe any third-party rights.
You agree not to: upload content that infringes intellectual property rights; use the Platform for any unlawful purpose; attempt to gain unauthorized access to any part of the Platform; upload malicious code or interfere with the Platform's operation; create multiple accounts to circumvent restrictions; engage in fraudulent transactions or chargebacks; scrape or harvest data from the Platform without permission.
Artists receive revenue shares as specified in their subscription plan. DeepWaves processes payments through third-party payment processors. Payouts are subject to minimum balance requirements and processing times as described in your plan. DeepWaves reserves the right to withhold payments in cases of suspected fraud or policy violations.
DeepWaves may suspend or terminate your account at any time for violations of these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the Platform ceases immediately. Content you have uploaded may be removed following account termination.
The Platform is provided "as is" without warranties of any kind, either express or implied. DeepWaves does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, DeepWaves shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to DeepWaves in the twelve months preceding the claim.
DeepWaves reserves the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the new Terms.
